These Terms of Service ("Terms") govern your use of the website www.optimalperformancemarketing.com and the services of Optimal Performance Marketing ("OPM," "we," "us," or "our"). By using this website or opting in to our text messaging program, you agree to these Terms.
1. Our services
OPM provides marketing, advertising, attribution infrastructure, and lead-generation services to businesses. Specific client engagements are governed by the applicable service agreement between OPM and the client.
2. SMS / Text Messaging Terms — "OPM Lead Alerts"
Program description
OPM Lead Alerts is a text messaging program that sends real-time notifications to OPM clients and OPM team members when a new lead comes in for their business, along with related account and service updates (for example: new-lead alerts with the lead's contact details, appointment or follow-up reminders, and campaign status updates). Messages are informational notifications related to services the recipient has engaged; this program is not used to send marketing messages to consumers or leads.
Consent / opt-in
You will only receive OPM Lead Alerts messages if you have given consent — by checking the SMS consent box on a form on this website, or by providing your mobile number and agreeing in writing to receive lead-alert texts during client or team onboarding (a public copy of the exact onboarding consent language is hosted at www.optimalperformancemarketing.com/sms-consent.html). By opting in, you consent to receive automated text messages from Optimal Performance Marketing at the mobile number you provided. Consent is not a condition of purchasing any goods or services.
Message frequency
Message frequency varies with lead volume. You may receive up to 10 messages per week, and more during periods of high lead activity, since an alert is sent each time a new lead arrives.
Message and data rates may apply for any messages sent to you from us and to us from you.
Reply STOP to cancel or opt out at any time. After you text STOP, you will receive one final message confirming your opt-out, and no further messages will be sent unless you opt back in.

Carriers
Carriers (e.g., AT&T, T-Mobile, Verizon) are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and is outside of our control.
Privacy
Mobile numbers and SMS opt-in data are handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes; text messaging originator opt-in data and consent will not be shared with or sold to any third parties.
3. Acceptable use of the website
You agree not to misuse this website, attempt to gain unauthorized access to it, or submit false or misleading information through our forms.
4. Intellectual property
All content on this website — text, design, graphics, and code — is the property of OPM and may not be reproduced without permission.
5. Disclaimers and limitation of liability
